General Terms and Conditions of Sale
A.   General Terms and Conditions of supply to the public of statistical data products published by the Insee
Article A1 - Rights of the Insee to the products it publishes
1.1 – To satisfy public needs in terms of demographic, economic and social data, and in accordance with its role, the Insee creates, organises and sells dissemination products made from the statistical data that it owns.
1.2 – Each of the dissemination products is an organised, structured set of information that has been processed in a specific way; owing to the choice and organisation of this information, it is an intellectual creation to which the Insee owns the copyright, as provided by Book I, Titles I and II of the French Intellectual Property Code (enacted part).
1.3 – The Insee is also the owner of the "rights of database producers" described in Book III, Title IV of the same code (law n° 98-536 of 1st July 1998) in respect to the substantial investments, in terms of both quantity and quality, that it has made to create these products and, notably, the selection and organisation of the data.
1.4 – Lastly, the Insee is the owner of the rights listed in Book VII of the abovementioned code for trademarks and service marks that it uses, duly recorded at the Institut National de la Propriété Industrielle (INPI), including its logo.
Article A2 – Right granted by the Insee to the purchaser of a dissemination product, and limits of this right
2.1 – The Insee grants, non-exclusively, to the purchaser of a dissemination product, the right to reuse the data, including for commercial purposes. This right is granted without payment of royalties and without a licence.
2.2 – Reuse of the data is subject to the condition that this data is not altered, its meaning is not denatured, and its source and the date of its last update are mentioned. Under no circumstances is the customer permitted to use the Insee logo.
Article A3 – Pricing of dissemination products
The price for the provision to the public of the dissemination products is set by a ruling of the Minister on whom the Insee depends.
Article A4 – Guarantee by the Insee - limits on responsibility
4.1 – The Insee undertakes to bring all care and attention to the communication of high-quality dissemination products. At the customer’s request, the Insee provides the customer with appraisals it has of the quality of the information transmitted.
4.2 – No other guarantee is given to the customer, who is obliged to formulate his or her needs clearly and to seek the information he or she requires. If data provided by the Insee appears to be incorrect, it is up to the customer to check the accuracy or the consistency of the results obtained.
4.3 – The Insee will not be responsible towards third parties for the use the customer makes of the information contained in the dissemination products. In particular, projections, interpolations and estimations of any kind that may be made by the customer from the data must be clearly identified as such and placed under the responsibility of their author, so as not to bring about any confusion in the eyes of the public with regard to the Insee product.
4.4 – If certain information provided by the Insee is recognised as being defective, and if the checks by the customer do not result in a remedy of this defective nature, and if proof is established that this defect is attributable to the Insee and has caused prejudice to the customer, the responsibility of the Insee will be limited, as a penalty, at the choice of the Insee, either to reimbursement of the price invoiced to the customer within the last two months of use of the data or to reimbursement of the payments made by the customer for the part of the services in which the defect is revealed.
4.5 – The responsibility of the Insee is not engaged in the event of a delay or failure due to a case of force majeure (all technical contingencies likely to affect connections, for example) or to an event out of the control of the Insee, or resulting from the customer’s own doing.
4.6 – By express agreement, at all events, no other tacit or implicit guarantee is given by the Insee, for direct or indirect, commercial or financial prejudice or for any other cause.
4.7 – The Insee is not responsible for the suitability of the information contained in its dissemination products to the objectives of customers or its proper use by customers.
Article A5 – Settlement of disputes
In the event that the parties are incapable of coming to an out-of-court settlement of any disputes or disagreements concerning or related to the application of the present General Terms and Conditions, the disputes or disagreements will be settled by the competent French courts.
B. Online Shopping Terms of Sale - Subscriptions
Preamble
The present Online Shopping terms of sale are a complement to the General Terms and Conditions of supply to the public of statistical data products published by the Insee.
Article B1 – Availability of the products
The products listed in the Insee catalogue are on sale subject to availability.
Article B2 – Prices and contribution towards postage costs
The prices indicated in the catalogue are the retail prices set by a ruling of the Minister for the Economy, Finances and Industry. The amount of the contribution towards postage costs depends on the area of delivery. Also set by a ruling, it is €3.50 for France and €6 for foreign countries.
Article B3 – Placing an order
A customer who wishes to buy a product must:
         fill out the identification form, indicating all the information required, or identify himself/herself by indicating his/her email address and password by which he/she is already recognised in the Online Shopping section ;
         fill out the online order form, giving all the references of the selected products ;
         validate the order after first checking it ;
         make payment under the conditions provided ;
         confirm the order and payment.
Confirmation implies acceptance of the present terms of sale.
Article B4 – Payment methods
Products are payable when the order is placed.
Payment is made by correspondence (cheque, credit card or bank transfer) or online by credit card.
Online payments are made via the secure Paybox Systemâ by the company Paybox Services, which uses SSL (Secure Socket Layer) technology, 128 bits, and the MD5 signature, so that the data transmitted is encrypted by a programme and no third party may be aware of the transaction across the network.
Article B5 – Delivery times
Delivery times are the usual postal delivery times. The products are sent by “Letter” or “Colissimo” package.
Article B6 – Subscriptions to national and regional publications
 6.1 – General principles
The subscription is annual for all periodicals. Its reference period starts on the 1st of the month following the date on which the request arrives. It applies to the issues to be published during the subscription reference period. Issues already published must be purchased individually.
 Requests for re-subscription must be made at the latest within the month following the due date. Unless a re-subscription request is made, the subscription is suspended one month after the due date, with no further notice given. Two reminders are sent, the first two months before the due date, and the second one month before.
 The number of issues per year is given as an indication only. Economie et Statistique (around 10 issues per year) may offer double or even triple issues for certain features. Insee Première (around 60 issues per year) is published according to statistics news.
 6.2 – National publications
 All the Insee’s national publications are referenced on insee.fr which, in nearly all cases, offers access to their full texts. In order to offer more comfortable reading, a display in htm format is currently being generalised.
They are all downloadable free of charge in PDF (Portable Document Format by Adobe), except for the Annales d’Economie et Statistique, for which only back-issues are accessible, and Recueil d’études sociales.
The free subscription to publishing notices allows you to keep informed by email of the hard-copy or electronic-copy release of the latest publications.
 A subscription for hard copy remains possible for the following publications, either using the order form or online (click on the name of the publication):

6.3 - Regional publications
 
Regional publications and offers are referenced on the regional pages of www.insee.fr.
Depending on the region, publications may or may not be consultable and downloadable free of charge in PDF.
Each region proposes its editorial line, accessible in electronic form and, in certain cases, paper form.
Certain regions propose a free subscription to the publishing notices that accompany each publication in paper form or electronic form, or even a free subscription to the publications themselves.
 
Some regions propose one or more paying subscriptions to their paper publications, with the possibility of subscribing online (click on the name of the region in Regional Publications) or via an order form.
 
Article B7 – Exchanges and refunds
 
7.1 – In the event of a defect in the product, the customer may return it to the Insee for an exchange or a refund. The cost of returning the product is refunded against a receipt.
 
7.2 – If, for a reason attributable to the Insee, delivery has not been made within thirty days following the order date, the customer may request a refund of the amounts paid to the Insee for the said order.
 
7.3 – Individuals have the right to retract for seven full days following the delivery date. The products returned to the Insee in the framework of this right are refunded on condition that the packaging is still intact. Return postage costs are not refunded.
 
7.4 – All requests for information relating to the conditions for the exchange or refund of a product must be sent by email to the Insee-Contact service: insee-contact@insee.fr.
Article B8 – Access to the Insee site
8.1 – The Insee undertakes to make its best efforts to make and keep its online services available. In this respect, it has an obligation of means. The Insee may not be held responsible in the event of an interruption of service caused by a failure or a malfunction in the internet or, more generally, any event out of its control.
8.2 – The Insee may not incur any responsibility in the event that the customer suffers damage owing to the use of the internet, for example loss of data or contamination by a virus.
8.3- The nominal information relating to users of the site www.insee.fr and associated sub-sites is subject to computerised processing declared to the French National Commission for Data protection and Liberties (CNIL) (declaration n° 727987 of January 3d, 2001).
Article B9 – Evidence in case of disputes
Order forms and their related invoices are archived by the Insee in a computerised register. This register is used as evidence in case of a dispute.
C. Special Conditions relating to Custom-Made Products (CMP)
Preamble
The present terms of sale relating to custom-made products are a complement to the General Terms and Conditions of supply to the public of statistical data products published by the Insee. Custom-made products are described in the Online Shopping section.
Article C1 - Quotations
The creation of a custom-made product is conditional upon the drawing-up by the Insee and the acceptance by the customer of a quotation.
Article C2 - Prices
The prices of custom-made products are set by a ruling of the Minister for the Economy, Finances and Industry. The total price indicated in the quotation is the net price to be paid by the customer.
Article C3 – Delivery times
The delivery time is indicated in the quotation. It runs from the date on which the Insee receives a copy of the said quotation, signed by the customer and bearing the wording “Accepted”.
Article C4 – Placing an order
The customer informs the Insee (via the online contact form, by letter or by fax) of his or her intention to place an order for a custom-made product. The request is handled as quickly as possible by the relevant Insee department, which defines along with the customer the content of the statistical tables which will form the custom-made product and sends the quotation to the customer.
The customer confirms the order by returning a copy to the Insee, duly signed and bearing the wording “Accepted”.
 
Article C5 - Payment
The amount to be paid by the customer features on an invoice to be paid within 30 days (45 days for a local authority). The payment methods are specified on the invoice.
